Terms and conditions for participating in journeys on the BVG U-Bahn Convertible

These terms and conditions of participation govern exclusively participation in the U-Bahn Convertible rides offered by Berliner Verkehrsbetriebe (BVG), a public-law institution. The organiser of the U-Bahn Convertible rides is Berliner Verkehrsbetriebe (BVG), AöR.

Tickets are purchased via an external ticketing provider. The purchase of tickets is governed exclusively by the general terms and conditions of the respective ticketing provider.

1. Ticket and Eligibility

Participation in the U-Bahn Convertible ride is only possible with a valid ticket. Each participant must have their own ticket. The ticket for the U-Bahn Convertible ride does not include travel to and from the event venue.

Commercial resale and resale via unauthorised platforms (e.g. eBay, Kleinanzeigen.de) is prohibited. The same applies to the use of tickets for competitions, prize draws or other promotional activities without the prior consent of the BVG.

In the event of any breaches, the BVG is entitled to exclude the persons concerned from taking part. In such cases, there is no entitlement to a refund of the ticket price, unless required by mandatory statutory provisions.

2. Conditions of participation (age, children and teenagers)

The minimum age for independent participation is 18.

Children aged 6 and over and teenagers under the age of 18 may only participate if accompanied by a responsible adult. Supervision must be ensured throughout the entire duration of their stay on BVG premises and during the journey.

3. Persons accompanying people with severe disabilities

Due to limited capacity and specific safety and organisational requirements, persons accompanying people with severe disabilities require their own (concessionary) ticket.

There is no entitlement to a free ticket for accompanying persons. This applies regardless of any special conditions entered on the severe disability card.

4. Safety guidelines and conduct whilst travelling

You must follow the instructions and directions of the driving and service staff at all times. The driving and service staff have the right to enforce house rules for the duration of the event.

For safety reasons, the following rules apply in particular:

  1. The safety helmets provided must be worn correctly whilst travelling and returned afterwards.
  2. You must not leave your allocated seat whilst the vehicle is in motion. Standing up is prohibited.
  3. It is forbidden to lean out of the vehicle or hold objects out of it.
  4. Smoking is strictly prohibited on BVG premises. The consumption of food and drink is not permitted during the journey.
  5. For safety reasons, persons under the influence of alcohol or who are visibly impaired may be excluded from taking part.
  6. Filming, photography and video recording are not permitted during the event.
  7. Bags, rucksacks and other containers larger than A4 size (approx. 21 cm × 29.7 cm) may not be brought into the event.
  8. Participants are obliged, at the request of the driving and service staff, to open any bags, rucksacks or other containers they are carrying for a visual inspection. The inspection is limited to a visual examination of the contents. No search will take place; items will not, as a rule, be touched by the driving and service staff.

Participation is at your own risk, subject to the specified safety regulations.

5. Exclusion from participation

The BVG is entitled to exclude persons from participating before the start of or during the journey, in particular if they do not hold a valid ticket, if they breach these terms and conditions of participation, if they fail to follow the instructions of driving and service staff, if there is reason to fear that safety may be compromised due to the consumption of alcohol or drugs, film, photographs or video recordings are being made, bags or other containers of an impermissible size are being carried, or a required visual inspection is refused.

In the event of exclusion, there is generally no entitlement to a refund, provided that this is not precluded by mandatory statutory provisions.

6. Changes, Cancellations and Service Disruptions

BVG is entitled to cancel, interrupt or adjust the timing and route of journeys for operational or safety reasons. No replacement journey will be provided.

In the event of a cancellation, interruption or significant change to the service (in particular, the complete cancellation of the journey), tickets already purchased will generally be refunded by the ticket provider. A claim for a refund applies only to tickets purchased through a ticket provider authorised by the BVG.

There is no entitlement to a refund for tickets purchased through unauthorised sales channels (in particular via platforms such as eBay or Kleinanzeigen.de).

The refund will be made after deduction of a flat-rate administration fee of 3,00 €, unless it can be demonstrated in individual cases that BVG incurred no costs or only significantly lower costs.

No further claims, in particular for reimbursement of wasted expenditure or damages, shall arise, unless BVG is guilty of wilful misconduct or gross negligence, or unless mandatory statutory provisions preclude this.

7. Liability

The BVG shall be liable without limitation in cases of wilful misconduct and gross negligence, as well as for damage resulting from injury to life, limb or health.

In all other respects, the BVG shall only be liable in the event of a breach of material contractual obligations and such liability shall be limited to the foreseeable damage that typically occurs. This also applies in favour of the vicarious agents, unless guarantees have been given or a defect has been fraudulently concealed.

8. Final provisions

Should any provision be invalid, this shall not affect the validity of the remaining provisions.

The version of the terms and conditions of participation in force at the time of booking shall apply.
